Improvements to Cleveland Avenue, Brook Drive North, Davenport Avenue, Wynwood Road, Beech Drive, Forest Avenue, Forest Court & Sun Valley Way. No bid may be withdrawn for sixty (60) days after the opening of bids. A Contract will be awarded to the lowest responsible bidder or all proposals will be rejected within sixty (60) days after the opening of bids. The Borough of Morris Plains reserves the right to reject all bids, to reject unbalanced bids, and to waive any informality in any bid. The work to be performed consists of the furnishing of all labor, equipment, materials and all else necessary to: repair and resurface approximately 3,725 tons of municipal roadway pavement, and perform other related work. The Contractor may commence work after the contracts are executed and after July 6, 2025. All work must be completed by August 22, 2025. This Contract is subject to all of the Department of Labor Safety and Health Regulations and to the applicable provisions of the Occupational Safety and Health Act of 1970. All bids shall be made on the forms furnished and shall be enclosed in a sealed envelope marked with the name and address of the Bidder, the name of the Owner, the Contract Number and Title. While Borough offices remain open during business hours, the Municipal Building is closed to the general public during this pandemic. Bidders submitting bids prior to the bid opening in the designated area of the parking lot for the Morris Plains Municipal Building, 531 Speedwell Avenue, Morris Plains, New Jersey are instructed to utilize the telephone in the outer lobby of the Municipal Building during business hours 8:30 AM to 4:30 PM to contact (1) the Borough Clerk's Office or (2) the Borough Treasurer/Finance Office to arrange for entry and access to the Drop Box installed in the lobby of the Municipal Building to deposit the sealed proposal. Each bid must be accompanied by a certified check, cashier's check, or bid bond in the amount of ten percent (10%) (not to exceed $20,000) of the total bid, payable to the Owner, as a guarantee that if the contract is awarded to the Bidder he will enter into a contract with the Owner. The successful Bidder will be required to furnish payment and performance bonds each in an amount equal to one hundred percent (100%) of the contract award. Each Bidder shall submit with his proposal a completed Consent of Surety Form, stating that the surety company will provide him with the required payment and performance bonds. The attention of the Bidder is called to the conditions of employment to be observed and minimum wage rates to be paid under the contract. The successful Bidder shall be required to comply with the provisions of the Department of Labor's current wage rate determination, The New Jersey Prevailing Wage Act, The Contract Work Hours and Safety Standards Act, The Copeland Act, and The Davis-Bacon Act. Each bidder must complete and submit the Ownership Disclosure Statement, the NonCollusion Affidavit and the Affirmative Action Assurance Form contained in the proposal package and Bidders and sub-contractors Business Registration Certificate, pursuant to P.L. 2004, C.57, N.J.S.A. 52:32-44, in order to be eligible for consideration for award of this Contract. In addition, when applicable, the Bidder shall be required to submit a list of specialty trade subcontractors who will be used on the Project, along with a certificate pursuant to P.L. 1997, c.408 Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 regarding affirmative action.
