The Town of Fountain Hills (the "Town") is issuing this Invitation for Bid (this "IFB") from qualified, licensed firms ("Vendors") as more particularly described in the Scope of Work. Notwithstanding anything to the contrary provided elsewhere in the Contract Documents, except for Binding Arbitration Procedure Scope of Award below, the alternative dispute resolution ("ADR") process provided for herein shall be the exclusive means for resolution of claims or disputes arising under, relating to or touching upon the Contract, the interpretation thereof or the performance or breach by any party thereto, including but not limited to original claims or disputes asserted as cross claims, counterclaims, third party claims or claims for indemnity or subrogation, in any threatened or ongoing litigation or arbitration with third parties, if such disputes involve parties to contracts containing this ADR provision. The Project limits include the north side of the Shea Boulevard intersection to approximately 360 feet north on both sides of Fountain Hills Boulevard, 40 to 80 feet beyond existing curbs (+/- 31,430 sf). The median on Fountain Hills Boulevard is not anticipated to be included as part of the design and construction for this project. The objective of this project is to develop a sustainable and aesthetic landscape that optimizes water usage and minimizes maintenance efforts within the Town's budget. his project involves: 1.Removing existing turf by herbicide, turf root obstructions, and debris to a depth of 4 inches below the exposed finish grade. 2.Removing existing decomposed granite within the project limits. 3.Removing select plant materials, including existing palm trees. 4.Removing the existing concrete header by Town staff. (no construction required) 5.Replacing the existing irrigation system (to be abandoned), reusing the existing irrigation meters and backflow devices, converting existing turf valves to a drip valve, and providing new irrigation controllers. 6.Install the electrical conduit for irrigation controller AC, the Town of Fountain Hills staff will make the final connection to the traffic signal point of delivery (POD). 7.Protecting and pruning select existing plant materials. 8.Protecting the existing utilities. 9.New design for desert landscape with low-maintenance treatment, including installing new decomposed granite in the turf removal areas and installing low-maintenance, low-water-use plant materials approved by the Arizona Department of Water Resources (ADWR). 10.Town of Fountain Hills will add a line item the bid tab as a lump-sum for traffic control. Question Deadline - 06/05/2025 at 5:30 PM MT- Bidders shall submit all inquiries regarding this bid via online. The Work included in this Project consists of Turf Replacement - Fountain Hills Blvd. and Shea Blvd. The Town reserves the right to review and reasonably object to the Subcontractors proposed, and the selected Contractor shall not retain a Subcontractor to which the Town has a reasonable objection.
