Each bid must be accompanied by a Certified Check orSurety Company's Bid Bondon the form provided in theBid Documents, naming aspayee or Obligee, the Boroughof Bally, Berks County in theamount of ten percent (10%)of the total bid submitted.The Surety Company must beacceptable to the Borough. No bid may be withdrawn after the above-specified datefor receiving, opening andreading of bids, except asspecifically may be providedby law. All Contracts exceeding$10,000.00 shall be performedin compliance with ExecutiveOrder 11246, entitled, "EqualEmployment Opportunity," asamended by Executive Order11375 and as supplementedin Department of Labor regulations (41 CFR Part 60). Inaddition, all Contractors shallcomply with the "Nondiscrimination/Sexual Harassment Clause" as required byPennsylvania Executive Order2016-05. Wages paid are subject to thePennsylvania Prevailing WageAct approved August 15, 1961,P.L. 987 as amended and supplemented. The PennsylvaniaHuman Relations Act of 1955,P.L. 744, No. 222, as amendedJune 25,1997 by Act 34 of 1997,43 P.S. 951-963, shall applyto this Contract if the Contract exceeds $100,000.00. The Bidder and all subcontractors must be prequalified by PennDOT for the typeof project work specified inorder to bid the project, andPennDOT prequalificationcertificates must be submitted by the Bidder and all subcontractors. The Borough of Bally, BerksCounty, reserves the right towaive any informalities in, orto reject any or all bids, and todelete any item or portion ofan item without affecting thebids on the remaining itemsor portion of items.
