Contract No. SD2428 SPS-7 and SPS-9 Site Improvements, the Work, includes, but is not necessarily limited to various site improvements at SPS-7 in Harvey Cedars and SPS-9 in High Bar Harbor. The Owner will act within sixty (60) days after the date of Bid opening to award the Contract to the lowest responsible bidder, reject all Bids or take any other appropriate action. The Owner expressly reserves the right to reject Bids, waive any minor informalities or non-material exceptions, re-advertise for Bids or withhold the award for any reason the Owner determines, in accordance with the applicable law. Any award may be made beyond sixty (60) days after any agreed upon extension of the award period, between the Bidders and Owner. The award of this contract is subject to the 10-day review period provided by N.J.S.A. 40:20-71.3. Prevailing Wages - The New Jersey Prevailing Wage Act, N.J.S.A. 34:11-56.27 et seq. is hereby made a part of the Contract. The Contractor's execution of the Agreement is its guarantee that neither it nor any subcontractors it has employed to perform the Work are listed or are on record in the Office of Commissioner, Department of Labor and Workforce Development, as one who has failed to pay prevailing wages in accordance with applicable law. Requests for Interpretation - All questions or inquiries concerning the Bidding Documents or the Work shall be submitted in writing to the Engineer. Bid Security - In accordance with N.J.S.A. 40A:11-21, each Bid shall enclose Bid Security, as specified in the Instructions to Bidders, in the amount of ten percent (10%) of the Bidder's Bid, but not in excess of $20,000. The site improvements at SPS-7 include the removal and disposal of trees, shrubs, stumps, vegetation, timber landscape ties, and chain-link fence, gate, and posts, the grading and installation of stone surfacing, an 8 ft wide stone dust path, the installation of 8 ft high chain-link fence with privacy slats, double swing gate, single swing gate, and any and all other work necessary for the proper completion of this Contract. The site improvements at SPS-9 include the removal and disposal of vegetation, timber landscape ties, and chain-link fence, gate, and posts, the grading and installation of stone surfacing, the installation of concrete curb, 6 ft high chain-link fence with privacy slats and double swing gates, the delivery and installation of Owner furnished plantings, the design and installation of an irrigation system, and any and all other work necessary for the proper completion of this Contract. For all Contracts for construction work, notice shall be provided no later than seven days, Saturdays, Sundays, or holidays excepted, prior to the date for acceptance of Bids, to any person who has submitted a Bid or who has received a Bid package in any ofthe following ways: Written questions or inquiries about the Bidding Documents or the Work received less than ten days before receipt of bids may not be answered
