The work includes the furnishing of all labor, material, and equipment necessary or required to complete the rehabilitation of the sanitary sewer pump station. Bids must be made on the standard Proposal form in the manner designated and enclosed in a sealed envelope bearing the name and address of the bidder and the name of the project on the outside. Bids must be accompanied by a Certified Check, Bid Bond, or Cashier's Check drawn to the order of the Borough of Berlin for ten percent of the total amount bid (not to exceed $20,000). Bid guarantees must be accompanied by an executed consent from an approved surety company, licensed in the State of New Jersey, agreeing to furnish the required Performance and Maintenance Bond upon award of contract. Signed Proposal forms and bid security must be delivered to the Municipal Clerk on or before the specified time. The accepted bidder must sign the contract within ten days after the Notice of Award or forfeit the bid security. Bid securities will be returned to all but the three apparent lowest responsible bidders. All other bid securities will be returned after awarding and signing of the contract and approval of the Contractor's Performance Bond. Bidders are required to comply with the requirements of N.J.S.A 10:5-31 et seq. and N.J.A.C. 17:27 (Affirmative Action Law); N.J.S.A. 52:32-44 (Business Registration Act); and N.J.S.A. 34:11-56.48 et seq. (Public Works Contractor Registration Act). The right is reserved to reject any or all Proposals, in whole or in part, or to make awards to such bidder or bidders, who, in the judgment of the Borough of Berlin, makes the most advantageous bid and to waive such informalities as may be permitted by law. Each and every bidder is hereby instructed that prior to submitting a bid, it is recommended that the bidder visit the site and carefully examine the existing conditions affecting the work and verify those items that impact the project. Additional labor, materials, and equipment required through failure to follow these instructions shall be provided by the Contractor at no additional cost to the Owner. Any explanation desired by bidders regarding the meaning or interpretation of the drawings and specifications must be requested to the Engineer in writing and with sufficient time allowed for a reply to reach them before the submission of their bids. Verbal explanations or instructions given before the award of the contract will not be binding. When hiring or scheduling workers in each construction trade, the contractor or subcontractor agrees to make good faith efforts to employ minority and women workers in each construction trade consistent with the applicable employment goal prescribed by N.J.A.C. 17:27-7.3; provided.
