All questions shall be submitted in writing to the Engineer and shall be postmarked at least ten (10) days before the established date for Bid opening. The work of this Contract includes, but is not necessarily limited to the following: Fencing Improvements shall include, but not be limited to, the following work; Remove and replace +/- 539 LF of 10' high chain link fence on the tennis court, install +/- 235 LF of 10' high chain link fence on the basketball court (no removal), install fence gates, and remove and replace +/- 125 LF 4' high chain link fence, including existing fence material disposal and all labor, materials and equipment necessary and incidental thereto. Each Bid must be accompanied by a proposal guarantee in the form of a Bid Bond or Certified Check for an amount equal to ten percent (10%) of the full amount of each Contract Bid, not to exceed $20,000. Surety shall be made payable to: Borough of Island Heights, and shall be without condition or qualification. The printing costs not refundable. All Bidders shall be required to comply with Chapter 127, P.L. 1975, c. 127, requiring each Bidder and each Subcontractor to formulate and submit to the proper authorized representative of the State of New Jersey an Affirmative Action Program of equal opportunity which guarantees minorities employment in all categories. The Borough reserves the right to waive any informalities or to reject any and all Bids, if it is in the public interest to do so. Each Proposal must be submitted utilizing the forms contained within the Contract Documents. It must be enclosed in a sealed envelope bearing on the outside the name of the BIDDER, his address and name of Project(s) for which the Bid is submitted. Materials to be contained within the sealed envelope are specified under "Instructions to Bidders." Bid Proposals shall be complete, in ink, and any Bids incomplete or not submitted in a sealed, specially addressed envelope may be considered informal. If the Bidder is a Corporation or a Partnership, the Bidder, in conformance with Chapter 33, P.L. 1977, shall submit with his Bid, a statement setting forth the names and addresses of all stockholders who own a 10 percent or greater interest in the firm.
