Each Proposal shall be accompanied by cash, money order, a certified or cashiers good faith check or a bond with corporate surety in an amount of at least ten percent of the total Proposal as a guarantee that if a Proposal is awarded and a purchase order is issued, and/or contract entered into, performance will thereby be properly secured. Before making any deliveries under the contract, the successful bidder shall execute and deliver to the Borough of Kutztown a performance bond in a sum not less than 100% of the total contract amount within ten days of the award of the Proposal having as surety thereon a surety company legally authorized to do business in the Commonwealth of Pennsylvania, conditioned for the complete and full performance of the obligations undertaken to be performed under the contract. The Council of the Borough of Kutztown reserves the right to hold any and all Proposals for a period not to exceed 60 days from the date of opening thereof, to waive any informalities, to reject any or all Proposals, to accept any part of any Proposal or the total Proposal, and/or issue a purchase order or enter into a contract for the Proposal that is in the best interests of the Borough.
