Bids will be received for a single prime contract which includes, but is not limited to: A lump sum price for construction of two accessible parking stalls including excavation, base aggregate, concrete curb and gutter, asphalt paving, concrete sidewalk, and associated work. Attendees can park in the parking lot west of the Labyrinth Garden off the main entry drive. City of West Bend reserves the right to reject any or all bids, subject to the provisions of Section 62.15 and 66.0901 of the Wisconsin Statutes. The City also reserves the right to waive bid defects at its sole option. The city reserves the right to request information and references before awarding the contract in order to determine the qualifications of the bidder to do the work of the contract. No bid shall be withdrawn for a period of sixty (60) days after the scheduled time of opening bids. The letting of work described herein, is subject to the provisions of Section 66.0901 Wisconsin Statutes, as it applies to work done under this contract. No bid will be received unless accompanied by a Certified Check or a Bid Bond equal to 5% of the bid, payable to the City of West Bend, Wisconsin, as a guarantee that if the bid is accepted, the successful bidder will execute and file the contract and payment and performance assurances, forming a part of the Specifications, within ten (10) days after the award of the contract. The payment and performance assurances must be for an amount at least equal to the contract price and must be in the form of a bond, an irrevocable letter of credit, or an escrow account acceptable to the City. In case the bidder fails to file such contract, performance bond, and payment bond, the amount of the check or bid bond shall be forfeited to the City as liquidated damages (Section 62.15(3) of Wis2005 Legal Notices consin Statutes).
