No bid will be received unless accompanied by a Certified Check or a Bid Bond equal to 5% of the bid, payable to the City of West Bend, Wisconsin, as a guarantee that, if the bid is accepted, the successful bidder will execute and file the contract and payment and performance assurances, forming a part of the Specifications, within 10 days after the award of the contract. The payment and performance assurances must be for an amount at least equal to the contract price and must be in the form of a bond, an irrevocable letter of credit, or an escrow account acceptable to the City. In case the bidder fails to file such contract, performance bond, and payment bond, the amount of the check or bid bond shall be forfeited to the City as liquidated damages (Section 62.15(3) of Wisconsin Statutes).
