Provide labor, materials and equipment to dewater and promote solar drying of primary wastewater sludge in the Woodbridge Sanitary District Wastewater Treatment Plant T1 Pond . Odor control measures shall be implemented, as needed, to mitigate odors to the surrounding residential neighborhood. Removal of sludge will commence after sufficient drying of sludge by transporting to an approved receiving facility. The work identified here is not meant to be an exhaustive or inclusive list but is intended to illustrate broadly the work required for completion of this project. No Contractor or Subcontractor May Be Listed on a Bid Proposal for a Public Works Project (Submitted on or After March 1, 2015) Unless Registered With the Department of Industrial Relations (Dir) Pursuant to Labor Code Section 1725.5. All Contractors and Subcontractors Must Furnish Electronic Certified Payroll Records Directly to the Labor Commissioner (Aka Division of Labor Standards Enforcement). No Contractor or Subcontractor May Be Awarded a Contract for Public Work on a Public Works Project (Awarded on or After April 1, 2015) Unless Registered With the Department of Industrial Relations Pursuant to Labor Code Section 1725.5 This Project is Subject to Compliance Monitoring and Enforcement by the Department of Industrial Relations. Notice: This contract is subject to the California Air Resources Board Off-Road Diesel Regulation (Title 13 CCR 2449). In order to be eligible to perform work under this contract, you must submit to the agency copies of the valid Certificates of Reported Compliance, as described in section 2449(n), for the fleet selected to perform work for this bid and any listed subcontractors, if applicable. If you do not submit said Certificates with your bid, your bid will be disqualified. No bid will be accepted unless Contractor and Subcontractor(s) are registered with DIR and it is made on the Bid Forms furnished by the District's Engineer. Fax bids will not be considered or accepted and will be grounds for rejection. The Bid Forms submitted shall contain all the information requested therein, signed, dated and affidavit notarized. Bid Bond (Bid Security) . - All bids shall be presented under sealed cover and accompanied by one of the following forms of Bidder's security: Bidder's Bond executed by an admitted surety insurer to operate in the State of California, made payable to Woodbridge Sanitary District or by a cashier's check, a certified check, or cash. The security shall be in an amount equal to ten percent (10%) of the amount bid. A bid will not be considered unless the form of Bidder's security is enclosed with it. Proposals submitted without one of the forms of Bidder's guarantee as listed above will be rejected. Companies supplying sureties or bonds shall be admitted to supply such instruments within the State of California, shall be listed by the Office of the Insurance Commissioner, and shall have a minimum A.M. Best rating of A and have a demonstrated ability to meet their ongoing obligations to policyholders. Closing Time and Withdrawal of Bids - Bids submitted after the fixed time deadline will not be accepted. Submitted bids may not be withdrawn after the fixed time, whether or not bids are opened exactly at the time fixed for opening bids. All bids are to be compared on the basis of the Engineer's estimate of the quantities of work to be done. Woodbridge Sanitary District reserves the right to reject any and all bids. Bid award will be made on the basis of a single schedule. The award, if made, will be to the lowest single responsive and responsible Bidder. Bid proposals in which the unit prices, lump sum price, or the total prices of the item are grossly "front-end" loaded or unbalanced with respect to costs, may be rejected. Bids submitted to the District by Contractor's who are not licensed in accordance with the provisions of Chapter 9, Division III of the Business and Professions Code, State of California, shall be considered non-responsive and shall be rejected by the District. Prospective Bidders shall be skilled, regularly engaged and licensed in the general class or type of work specified and possesses a valid California Class "A" Contractor's License with Hazardous Substance Removal Certification. The Bidder whose proposal is accepted must furnish Performance and Payment Bonds equal to one hundred percent (100%) of the Contract price for each bond in accordance with the provisions set forth in the Project Specifications. The Bidder shall carefully examine the work site, the plans and specifications, the proposal, and contract forms. Therefore, the submission of a bid shall be conclusive evidence that the Bidder has investigated and is satisfied as to the conditions to be encountered, as to the character, quantity, and scope of the work to be performed, the quantities of materials to be furnished, and as to the requirements of the proposal, plans, specifications, and the contract. Bidders on this work must comply with all applicable Federal, State, County and local agency requirements. In accordance with the provisions of Sections 1770 to 1781 of the Labor Code, the Director of the Department of Industrial Relations has ascertained the general prevailing rate of wages applicable to the work to be done. For more particular details, and a schedule of the applicable prevailing rate of wages, contact the office of the State's Division of Labor Statistics and Research or the nearest Bureau of Field Enforcement or the State Division of Labor Standards Enforcement or you may contact the office of North Valley Labor Compliance Services at (530) 635-1575. Bid Protests - Any bid protest must be submitted in writing to the District before 5:00 p.m. of the 7 th business day following bid opening. The initial bid protest document shall contain a complete statement of the basis for the protest. The protest shall refer to the specific portion of the document which forms the basis for the protest. The protest shall include the name, address and telephone number of the person representing the protesting party. The party filing the protest shall concurrently transmit a copy of the initial protest document and any attached documentation to all other parties with a direct financial interest which may be adversely affected by the outcome of the protest. Such parties shall include all other Bidders who appear to have a reasonable prospect of receiving an award depending upon the outcome of the protest. The District will issue a decision on the protest. If the District determines that a protest is frivolous, the party originating the protest may be determined to be irresponsible and that party may be determined to be ineligible for future contract awards. The procedure and time limits set forth in this section are mandatory and are the Bidder's sole and exclusive remedy in the event of Bid protest and failure to comply with these procedures shall constitute a waiver of any right to further pursue the bid protest, including filing a Government Code Claim or legal proceedings.
