The name and address of the bidder and the name of the project shall also appear on the outside of the envelope. Proposals must be submitted on the forms provided by the Engineer. A bid bond, or certified check/bank draft drawn on a solvent bank, payable without condition to the Village of Bolingbrook in an amount not less than five percent (5%) of the bid shall be submitted with each proposal, as a guarantee that, if the proposal is accepted, a contract will be entered into, and the performance of the contract is properly secured. A performance bond in a sum equal to one hundred percent (100%) of the amount of the bid, with sureties to be approved by the Village of Bolingbrook for the faithful performance of the contract, must be furnished by the successful bidder. A payment bond shall also be provided. All bids or proposals shall contain an offer to furnish these bonds upon acceptance of such bid or proposal. Bidder qualifications and experience will also be included in the basis for determining the lowest responsible bidder. The right is reserved to reject any or all proposals, to waive technicalities, to postpone the bid opening, or to advertise for new proposals, if in the judgment of the Village of Bolingbrook their best interests will be promoted thereby. Prequalification will be required to be submitted to the Engineer by all potential bidders. The Contractor shall have sufficient experience and shall demonstrate they have completed as a general contractor at least three (3) wastewater treatment plant projects involving installation of treatment equipment having individual contract values over $1,500,000 in the last ten (10) years. If in the opinion of the Engineer and the Village of Bolingbrook, an applicant would not be able to serve the best interest of the Village, a proposal will not be issued to the applicant. Any contract or contracts awarded under this invitation to bid are expected to be funded in part by a Housing and Urban Development (HUD) Community Development Block Grant (CDBG) through Will County, Illinois. The Bidder agrees to fulfill the provisions as specified in Exhibit B - CDBG Public Facilities Projects and all applicable administrative rules throughout the life of the contract. The Bidder shall also comply with all applicable Federal, State and local regulations. Attention of bidders is particularly called to the requirements as to conditions of employment to be observed and prevailing wage rates to be paid under the contract, Section 3, Segregated Facility, Section 109 and E.O. 11246. Section 3 of the Housing and Community Development Act of 1968 applies to the project. Therefore, the Will County Section 3 Plan and procedures for compliance apply to the project. MBE/WBE: Women and Minority Owned Businesses are encouraged to submit a proposal. The Contract shall be subject to the provisions of the Prevailing Wage Act (820 ILCS 130/1 et seq.) to the extent required by law as well as the Davis-Bacon Act. All rulings and interpretations of the Davis-Bacon and Related Acts contained in 29 CFR Parts 1, 3, and 5 are applicable. The Prevailing Wage Act and the Davis-Bacon Act labor for this project shall be the higher hourly rate at the time of bid, per the Will County Purchasing Ordinance. The Contract shall comply with the requirements of the Build America, Buy America (BABA) Act, 41 USC 8301 notes, and all applicable rules and notices, as may be amended. All bids shall include evidence that shows verification of being in good standing with the System for Award Management online.
