The Work contemplated under this Contract includes all labor, materials, transportation, equipment and services for, and incidental to, the completion of all construction work in connection with any Project described in the Contract Documents. The Contractor shall perform all Work necessary so that the Project can be legally occupied and fully used for the intended use as set forth in the Contract Documents. All bidders must comply with requirements of the prevailing wage law in ORS 279C.800 through ORS 279C.870. No offer will be received or considered by Owner unless the offer contains a statement by the bidder as a part of the offer that states: "Contractor agrees to be bound by and will comply with the provisions of ORS 279C.838, 279C.840 or 40 U.S.C. 3141 to 3148." All bidders must be registered with the Construction Contractor's Board at the time of bid submission. No bid will be considered unless fully completed in the manner provided in the "Instructions to Bidders" upon the Bid form provided. WORK, means performance of construction-related services, including the furnishing of all materials, equipment, labor, transportation, services and incidentals necessary to successfully complete, as applicable, any individual item, Project, or the entire Contract and the carrying out of duties and obligations imposed by the Contract Documents. When the Contract Price is exceeds $100,000, including circumstances in which the Contract Price exceeds $100,000 due to an Amendment, the Contractor shall furnish and maintain in effect at all times during the Contract Period a performance bond in a sum equal to the Contract Price and a separate payment bond also in a sum equal to the Contract Price. Contractor shall furnish such bonds even if the Contract Price is less than the above thresholds if required by the Contract Documents. If an Amendment causes the Contract Price to exceed $100,000, then Contractor shall furnish and maintain performance and payment bonds as required by this section. Prevailing Wage Rates requirements do not apply to this Project because the maximum compensation for all Owner-contracted Work does not exceed $50,000. The Owner reserves the right to reject all Bids and to waive minor informalities.
